01 Aceptacion de los terminos

Al acceder o utilizar los servicios de Clawdito AI ("el Servicio"), operado por Sebastian Montes (Argentina), aceptas estos Terminos y Condiciones en su totalidad. Si no estas de acuerdo, no deberias utilizar el Servicio.

Estos terminos aplican a todos los usuarios del Servicio, incluyendo clientes (negocios que contratan el Servicio) y usuarios finales (pacientes o clientes de esos negocios que interactuan con el asistente por WhatsApp).

02 Descripcion del servicio

Clawdito AI es una plataforma de asistentes virtuales impulsados por inteligencia artificial que ofrece:

Agente de atencion automatica por WhatsApp (respuestas, turnos, recordatorios)
Agente supervisor en Telegram para gestion y configuracion
Dashboard web para administracion del agente
Integracion con Google Calendar para gestion de turnos
Envio de mensajes proactivos (recordatorios, seguimientos, campanas de reactivacion)

El Servicio utiliza la API oficial de WhatsApp Business de Meta y esta sujeto a los Meta Platform Terms.

03 Requisitos de uso

El cliente debe tener un numero de telefono valido para WhatsApp Business (no vinculado a WhatsApp personal)
El cliente es responsable de obtener el consentimiento de sus usuarios finales para recibir mensajes automaticos
El cliente se compromete a no utilizar el Servicio para enviar spam, mensajes no solicitados o contenido ilegal
El cliente debe proporcionar informacion precisa sobre su negocio, servicios y precios

04 Suscripcion y pagos

El Servicio funciona bajo un modelo de suscripcion mensual. El precio actual y las condiciones de pago se informan al momento de la contratacion y estan visibles en la pagina de precios.

El pago se realiza de forma mensual, por adelantado
Los metodos de pago aceptados incluyen Mercado Pago y transferencia bancaria
En caso de falta de pago, el Servicio puede ser suspendido despues del periodo de gracia correspondiente
No hay permanencia minima. El cliente puede cancelar en cualquier momento

05 Propiedad intelectual

El software, diseno, codigo, marca y documentacion de Clawdito AI son propiedad de Sebastian Montes. El cliente recibe una licencia de uso no exclusiva, no transferible y revocable durante la vigencia de la suscripcion.

El contenido cargado por el cliente (servicios, precios, politicas, datos de pacientes) es propiedad del cliente. Clawdito AI no reclama derechos sobre ese contenido.

06 Limitacion de responsabilidad

Clawdito AI se provee "tal cual" (as-is). No garantizamos que el Servicio sea ininterrumpido, libre de errores o que cumpla con todos los requisitos especificos del cliente.

No somos responsables por decisiones tomadas por el asistente que resulten inadecuadas para un caso especifico
No somos responsables por interrupciones causadas por terceros (Meta, Google, proveedor de hosting)
La responsabilidad maxima de Clawdito AI esta limitada al monto pagado por el cliente en los ultimos 3 meses de servicio

Importante: El asistente virtual no provee asesoramiento medico, legal o financiero. Las respuestas automaticas son de caracter informativo y operativo (agendamiento, precios, horarios).

07 Privacidad y datos

El tratamiento de datos personales se rige por nuestra Politica de Privacidad. Al utilizar el Servicio, el cliente acepta los terminos de dicha politica.

El cliente es responsable de informar a sus usuarios finales sobre la existencia del asistente automatico y de obtener los consentimientos necesarios segun la legislacion aplicable.

08 Cancelacion

El cliente puede cancelar la suscripcion en cualquier momento, sin penalidad
Al cancelar, el Servicio permanece activo hasta el final del periodo ya pagado
Los datos operacionales se eliminan dentro de los 30 dias posteriores a la cancelacion
Clawdito AI se reserva el derecho de suspender o cancelar cuentas que violen estos terminos

09 Modificaciones

Podemos actualizar estos terminos periodicamente. Los cambios significativos seran comunicados a los clientes activos por correo electronico o por el canal de Telegram del supervisor. La version vigente siempre estara disponible en app.clawdito.ai/terms.html.

10 Jurisdiccion y ley aplicable

Estos terminos se rigen por las leyes de la Republica Argentina. Cualquier controversia sera sometida a la jurisdiccion de los tribunales ordinarios de la ciudad de Santa Rosa, La Pampa, Argentina.

Terms of Service

01 Acceptance of terms

By accessing or using the services of Clawdito AI ("the Service"), operated by Sebastian Montes (Argentina), you accept these Terms of Service in their entirety. If you do not agree, you should not use the Service.

These terms apply to all users of the Service, including clients (businesses that subscribe to the Service) and end users (patients or customers of those businesses who interact with the assistant via WhatsApp).

02 Description of service

Clawdito AI is an AI-powered virtual assistant platform that offers:

Automated WhatsApp customer service agent (responses, appointments, reminders)
Telegram supervisor agent for management and configuration
Web dashboard for agent administration
Google Calendar integration for appointment scheduling
Proactive messaging (reminders, follow-ups, reactivation campaigns)

The Service uses Meta's official WhatsApp Business API and is subject to the Meta Platform Terms.

03 Usage requirements

The client must have a valid phone number for WhatsApp Business (not linked to personal WhatsApp)
The client is responsible for obtaining consent from their end users to receive automated messages
The client agrees not to use the Service for spam, unsolicited messages, or illegal content
The client must provide accurate information about their business, services, and prices

04 Subscription and payments

The Service operates on a monthly subscription model. The current price and payment conditions are provided at the time of contracting and are visible on the pricing page.

Payment is made monthly, in advance
Accepted payment methods include Mercado Pago and bank transfer
In case of non-payment, the Service may be suspended after the applicable grace period
There is no minimum commitment. The client may cancel at any time

05 Intellectual property

The software, design, code, brand, and documentation of Clawdito AI are the property of Sebastian Montes. The client receives a non-exclusive, non-transferable, revocable license to use the Service during the active subscription period.

Content uploaded by the client (services, prices, policies, patient data) remains the property of the client. Clawdito AI does not claim rights over such content.

06 Limitation of liability

Clawdito AI is provided "as-is". We do not guarantee that the Service will be uninterrupted, error-free, or that it will meet all specific requirements of the client.

We are not responsible for decisions made by the assistant that may be inappropriate for a specific case
We are not responsible for interruptions caused by third parties (Meta, Google, hosting provider)
The maximum liability of Clawdito AI is limited to the amount paid by the client in the last 3 months of service

Important: The virtual assistant does not provide medical, legal, or financial advice. Automated responses are informational and operational in nature (scheduling, prices, hours).

07 Privacy and data

The handling of personal data is governed by our Privacy Policy. By using the Service, the client accepts the terms of said policy.

The client is responsible for informing their end users about the existence of the automated assistant and for obtaining the necessary consents under applicable law.

08 Cancellation

The client may cancel the subscription at any time, without penalty
Upon cancellation, the Service remains active until the end of the already-paid period
Operational data is deleted within 30 days after cancellation
Clawdito AI reserves the right to suspend or cancel accounts that violate these terms

09 Modifications

We may update these terms periodically. Significant changes will be communicated to active clients via email or through the Telegram supervisor channel. The current version is always available at app.clawdito.ai/terms.html.

10 Jurisdiction and applicable law

These terms are governed by the laws of the Argentine Republic. Any dispute shall be submitted to the jurisdiction of the ordinary courts of the city of Santa Rosa, La Pampa, Argentina.
